Terms of service
Last updated: November 1, 2026
These terms apply when you use the Catchwise website, our live demo, the client portal, or the Catchwise service ("the service"). "We" and "us" means Catchwise. "You" means the business that signs up, or anyone using our website. By using the service you agree to these terms. Our privacy policy explains how we handle personal information.
1. What Catchwise does
Catchwise provides AI assistants for businesses. Depending on your plan, the service can text back callers whose calls you miss, reply to customer messages, answer the chat on your website, and book appointments into the calendar we manage for you. You can see bookings and change some settings in the client portal.
2. Your account
- You must be able to form a binding contract and use the service for a genuine business.
- Keep your portal login private. You're responsible for what happens under your login. Tell us straight away if you think someone else has used it.
- The information you give us about your business (services, prices, service area, hours) must be accurate. The assistant uses it to answer customers, so keep it up to date.
3. Texting your customers
- You confirm you're allowed to receive calls and messages from the customers who contact your business, and that texting them back about their enquiry is something they'd reasonably expect.
- You must not ask us to send marketing or promotional texts, bulk messages, or anything unlawful, misleading or offensive.
- Customers can reply STOP to stop texts at any time. We honour opt-outs automatically, and you must not try to get around them.
- Texting in the US requires carrier registration (called A2P 10DLC). You agree to give us accurate business information for that registration.
4. AI has limits
The assistant is designed to be accurate and to stick to the facts you give us, but AI can make mistakes. In particular:
- It is not an emergency service. For dangers such as gas leaks or flooding it tells customers to get to safety and contact emergency services, and alerts you, but you remain responsible for responding.
- Prices and times it gives are based on your information. You should confirm jobs as you normally would.
- Calls and messages depend on phone networks, carriers and third-party providers, so we can't guarantee every message is delivered.
5. Plans, payment and cancelling
- Plans are billed monthly in advance at the price shown when you sign up. A one-time setup fee may apply.
- There's no long-term contract. You can cancel at any time and the service stops at the end of the month you've paid for. We don't refund partial months, except under the guarantee below.
- One-job guarantee: if Catchwise doesn't win you at least one extra job in your first month, your first month's plan fee is refunded or not charged. Ask us within 14 days of the end of your first month.
- If a payment fails, we may pause the service until it's paid.
- We may change prices with at least 30 days' notice. You can cancel before the change takes effect.
6. Acceptable use
Don't use the service to break the law, harass anyone, send spam, collect people's information without permission, or try to break, overload or get around the security of our systems or the live demo. We may suspend accounts that do.
7. Your data and ours
Your customers' details and conversations belong to you. We use them only to run the service for you, as described in our privacy policy, and we'll give you a copy if you ask when you leave. The Catchwise software, website, branding and assistant designs belong to us.
8. The live demo
The "Try it live" page uses a pretend business. Please don't enter real personal details there. Demo conversations and bookings are reset daily and no real texts are sent.
9. Liability
We provide the service "as is" and do our best to keep it running and accurate. To the extent the law allows, we aren't liable for lost profits, lost jobs, or indirect losses, and our total liability for any claim is limited to the amount you paid us in the 3 months before the claim. Nothing in these terms limits liability that can't legally be limited.
10. Changes and ending the service
We may update these terms. If a change is important we'll tell you at least 14 days before it applies. We may end the service with 30 days' notice, or straight away if these terms are seriously broken.
11. Governing law
These terms are governed by the laws of the State of California, USA.
